When to Consider a Prenup

Are you recently engaged and planning a wedding? If you will be on your honeymoon soon, it’s important that you’ve considered a prenup with your soon-to-be spouse.

With nearly half of all marriages ending in divorce, a prenuptial agreement can be a valuable financial instrument for a marriage.

Although prenups have been taboo due to their pejorative aspect, today’s reality is that prenuptial agreements open the doors for partners to openly discuss money, debt, living, life insurance, trusts, living wills, and future planning.

Prenuptial agreements are used to clarify the interests and protect the assets of both parties entering the marriage. The contract defines personal assets, liabilities, property, as well as any dependents from prior relationships. The agreement outlines responsibilities of each party during the marriage and what would happen in the case of divorce or death.

Without prenuptial agreements, a divorce may result in salient financial support or alimony to your spouse. Similarly, a spouse entering the marriage with significant assets (financial, real estate, equity, etc.) and no prenup could risk losing a large portion of it to the spouse in a divorce. Furthermore, it can be difficult to ensure that a child or children of one parent will inherit explicit assets after a divorce or death of that parent without a signed prenuptial agreement.

Prenuptial agreements aren’t just about financial elements, though. Increasingly, prenups have lifestyle clauses designed to protect a spouse’s reputation. Social media clauses focus on prohibiting disparaging comments or images on social media. Violations may result in hefty fines.
